A three-judge panel of the 4th U.S. Circuit Court of Appeals, rendered its decision saying accused terrorist Zacarias Moussaoui must be allowed to conduct a live video deposition with alleged September 11 attack coordinator Ramzi Binalshibh, a Yemeni national being detained as an enemy combat at a military installation outside the United States.
Attorney General John Ashcroft has said he will not make Binalshibh available. Instead, the government's case will be abandoned and Moussaoui will be tried by a military tribunal, severly curtailing any civil rights, including the right to call witnesses in his favor.
