Source: The TIP, 2004-02-06 Candidate: Big Government When Hillary Clinton voiced her suspicion of a "Right Wing Conspiracy" organized to oust her husband from the office of President, she was severely criticized by every media outlet and, in particular, every Republican source from Newt Gingrich to Richard Melon Scaife. Since then, several would-be conspirators have admitted to an organized effort to permanently take-over the government - but they take issue with the word “conspiracy” since it insinuates secrecy - there is no conspiracy, they say, it is overt! Americans ignored Clinton’s warning. In 2000, the Republican Party brought to bear every dirty trick in the book to bring into line the only and last piece of government still free from its web - the Presidency. Reprehensible tricks, like accusing John McCain of having a black child to alarm Republican voters (the McCains adopted an orphan from Bangladesh), using a faulty computer program to prevent hundreds of thousands of black voters from voting in Florida, importing dozens of Republican Congressional Staffers to Florida to act like “angry white men” preventing the vote counting, and finally, Supreme Court Justices turning a blind eye to what they knew to be the worst decision since Dread Scott - the whoring of Democracy itself. In particular, Supreme Court Justice Antonin Scalia, who, without question, should have recused himself, was the single Justice to bring the Bush v Gore case to the Supreme Court. Scalia’s own son was one of the attorneys for Bush - creating a conflict of interest so wide it supplants the Colossus of Rhodes as the Seventh Wonder of the World. The deed was done. America lay in ruins after that election. When two jet airliners flew into the World Trade Center Towers, it was only a graphic depiction of what George W. Bush and the Republican Party had already done to America. But, Bush and Company weren’t finished. The Republicans didn’t want George Bush installed as president for no reason. Theirs is an agenda of greed, rape and pillage the likes of which haven’t been seen since the Barbarian Hordes overran the Roman Empire leaving no stone unturned, no village without scars. Without exception, the Bush Administration is worst thing that has ever happened to America. $535,000,000,000 deficit THIS YEAR ALONE, folks. Does anyone have any idea how much money that is? At $7,200.00 per hour, it will take 2,120 years to make that much money. Can we talk about interest on that deficit? American is in hock 'til Kingdom Come. And who is the recipient of this money? Not you or I! Nor anyone I know. Look to the White House, folks. Look to the Bush Administration. Everyone one of them multi-millionaires and greedy for more and more and more. They are insatiable. Just a month ago, Vice President Richard Cheney used our money to go hunting with his old pal Justice Scalia at the camp of a multimillionaire oil-services tycoon, another longtime friend of Scalia's. Was it coincidence that the Supreme Court had agreed to hear arguments in April in the case of "in re Richard B. Cheney, the vice president's appeal in lawsuits over his handling of the administration's energy task force. Several experts in legal ethics questioned the timing of their trip and said it raised doubts about Scalia's ability to judge the case impartially. Federal law says "any justice or judge shall disqualify himself in any proceeding in which his impartiality might be questioned." Yet Scalia rejected that concern Friday, saying, "I do not think my impartiality could reasonably be questioned." Call me irresponsible, but I think Scalia’s impartiality is easily questioned, on this and any other subject concerning his “old friend” Richard Cheney. I certainly wouldn’t want to argue a case in any court against an “old friend” of the judge. Any judge in any jurisdiction in the land would routinely recuse themselves from such a situation. Stephen Gillers, a New York University law professor, said Scalia should have skipped going hunting with Cheney this year. "A judge may have a friendship with a lawyer, and that's fine. But if the lawyer has a case before the judge, they don't socialize until it's over. That shows a proper respect for maintaining the public's confidence in the integrity of the process," said Gillers, who is an expert on legal ethics. "I think Justice Scalia should have been cognizant of that and avoided contact with the vice president until this was over. And this is not like a dinner with 25 or 30 people. This is a hunting trip where you are together for a few days." Steven Lubet, who teaches judicial ethics at Northwestern University Law School, said it was possible for lawyers to be friends with a judge sitting on a case, but litigants must not be. “Cheney is the litigant in this case,” Lubet said. “The question is whether the justice's hunting partner did something wrong. And the whole purpose of these rules is to ensure the appearance of impartiality in regard to the litigants before the court.” The code of conduct for federal judges sets guidelines for members of the judiciary. A judge should "act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary," it says. "A judge should not allow family, social or other relationships to influence judicial conduct or judgments," nor should a judge "permit others to convey the impression that they are in a special position to influence the judge." In the lower courts, litigants may ask a judge to step aside. And if the request is refused, they may appeal to a higher court. But at the Supreme Court, the justices decide for themselves whether to step aside. Justice Scalia is incapable of making that judgment. He is a man without scruples, a judge without judgment.
